An elderly man with capital now below the threshold for a financial subsidy and commisisoning from the council is told that his relatives will have to pay a top up if he wants to stay in the home that he originally chose when self funding. After all other attempts at referring the council to the need to assess whether his needs, including his emotional and psychological needs, could be met appropriately if he were to be forced to move, had failed, another line of attack worked: asking the council how many homes in the county actually take the rate that the council pays, as the full contractual rate, or instead, charge a top up? The council simply didn’t know.
