Residential accommodation – private sector – refusal to award contract – ultra vires

The local authority’s refusal to award a nursing home proprietor a contract without sight of fully audited accounts was neither ultra vires nor unreasonable. The council was entitled to insist on full accounts as a means of ensuring that potential homes were financially viable and able to provide long-term care, thus providing the best care services for frail elderly people.
