Mental disorder – eviction – reasonableness

A psychiatrist’s finding that the defendant suffered from a personality disorder was a relevant consideration when assessing the reasonableness of making a possession order on the ground of nuisance. The court was not entitled to reject the medical evidence. The future prospects of the defendant, if the order for possession were made, should also be considered.
