Community care services – assessments – joint working

An application for judicial review of local authority’s decision to provide no community care services to the applicant and of the local authority’s continued failure to reassess or secure a joint multi-disciplinary assessment of the applicant’s needs was settled by consent. Where there is an impasse between two potentially responsible authorities neither authority may lawfully refuse to make any social or health care provision but each authority must, in the absence of a lawful joint multi-disciplinary assessment of need, provide emergency social and health care support until such time as that assessment has been completed.
