Legitimate expectation – policy change

A claim by civil servants that a circular reducing their retirement age to 60 was in breach of a reasonable expectation created by an earlier departmental circular that the retirement age would be 65, was unsuccessful. The Court held that that expectation could only exist as long as the original policy was in force, and was ended by notification of a new policy to contrary effect.
