Registered Homes Act 1984 – personal care – defence

Where the relevant authority under the Registered Homes Act 1984, ie the local authority, had consistently claimed that an establishment was a residential care home, the fact that other courts had held that the establishment was not a residential care home was not sufficient to establish a defence under s18 of the Act. Thus, reliance could not be placed on a decision of the High Court, that for council tax purposes, the establishment was a hostel and not a registered care home.
