Residence dispute – s24 Children Act 1989

In a dispute between two local authorities about which of them was responsible for continuing to provide advice, assistance and support for a child who had been in care and now reached the age of 18 years, the court ruled that, by virtue of s24(2) Children Act 1989, a person qualifying for advice and assistance meant a person within the area of the authority; and therefore the authority within whose area the child was living at the time bore the responsibility, irrespective of whether this was the same authority which had looked after the child. In this case, the child had been placed by Lambeth with a foster mother in Kent, before moving into independent accommodation at the age of 18. Kent was therefore the responsible authority.
