Policy – guidance

A decision by a local authority which did not follow Policy Guidance was in breach of the Local Authority Social Services Act 1970 s7(1) and therefore unlawful. A local authority’s rejection of a Complaints Review Panel’s recommendations, without giving any or adequate reasons, may give rise to a strong prima facie case for quashing the decision as unlawful on Wednesbury grounds, but each case will tun on its facts.
