Waltham Forest, ex parte Vale [1985] (The Times, 25 February 1985) (QBD)

Residential accommodation – ordinary residence

The ordinary residence (for the purpose of assistance under s21 National Assistance Act 1948) of a 28 year old mentally handicapped woman was her parental home, despite the fact that she had lived there for only one month. The judge found that the woman was so totally dependent on her parents as to be in the same position as a child, and that one month could be sufficient to constitute ordinary residence.
