Breach of statutory duty – negligence – cut in services – s2 Chronically Sick and Disabled Persons Act 1970 – private law

There was no claim in private law against the local authority for breach of statutory duty or negligence to enforce a particular level of claimed home help under s2 Chronically Sick and Disabled Persons Act 1970. The court said it would be “quite extraordinary if the local authority…provided, for example two hours less home help than the sick person considered herself entitled to that that can amount to a breach of statutory duty which will permit the sick person to claim a sum of monetary damages by way of breach of statutory duty”.
